13. The People who are Excused to Break, Doing it Publicly/Openly.
It came in Saheeh Bukhari (1) from the Hadeeth of Abū Sa'eed رضى الله عنه narrated that the Prophet of Allaah صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ said:
" أَلَيْسَ إِذَا حَاضَتْ لَمْ تُصَلِّ، وَلَمْ تَصُمْ ؟ " قُلْنَ : بَلَى. قَالَ : " فَذَلِكِ مِنْ نُقْصَانِ دِينِهَا ".
Is it not that if she is menstruating, she doesn't do salah and doesn't fast? He said: of course. He said: that's from the defect in her Deen.
Commentary:
The hadeeth points to the prohibition of fast for the menstruating women, and ahaadeeth have come for the prohibition of fast for the post partum woman, just like authentic ahaadith points to the permissibilty for breaking for the traveller and sick.
These are from what there is no difference of opinions about.
However, from the mistakes is that the ones excused, break in front of the lay men, they exempt journey between the travellers, because this action can bring about accusation to the self.
This can be a cause of not revering the sanctity of the honored month amongst the lay men, and revering the sha'aa-iri (signs) of Allah.
As for the kids, hiding breaking in their presence so as to bring them up upon revering this honored month and revering the sha'aa-iri (signs) of Allah.
As for the one who sights the Crescent of ramadan or Shawwaal and he conveyed it to the people of authority, and the authority did not consider him. Then this, for him is to fast secretly and break secretly. So that he would not show his opposition to the Jama'ah (congregation).
